CHawaii Driving Under the Influence Lawyers
Hawaii DUI Lawyers
In Hawaii, repeat offenders run the risk that convictions will be treated as felony. Even first time offenders risk imprisonment, fines, community service, increased or cancelled automobile insurance and a criminal record.
•
For just a first offense there is no minimum jail time though the judge can sentence you to jail time. If there was a child (under fifteen) in the car there's a minimum 48 hours of jail time.
•
There are fines which increase if a child was in the car.
•
Your license will probably be suspended. If your BAC (Blood Alcohol Content) is .15 or over an extra six months is added to your license suspension.
•
If you refuse to take a chemical, test you will lose your license for one year.
•
You will have to do community service and may be ordered to take an education course.
•
You will have to install an ignition interlock device on your car for a definite period of time to make sure you don't drive while drunk.
Hire a Hawaii DUI lawyer to help you win your case and avoid these severe consequences.
HI Drunk Driving Attorney Cases
If you think a first conviction for drunk driving is rough, consider the added consequences for just a second conviction.
For a first conviction there's no minimum jail time. For a second offense there is a minimum jail sentence of five days unless you do 240 hours (30 eight hour days) of community service
A chemical test refusal means you will lose your license for two years, as opposed to one year for a first time offense.
Your license will be suspended for a year, instead of for up to 90 days. As for first time offenders, an ignition interlock device will be required.
For both a first and second conviction there are added penalties for having a child in the car and you will have to pay fines and take a court ordered education program.
Hire a dedicated HI drunk driving attorney to help you assert all your defenses such as whether the police stop was proper and whether the chemical test was properly given.
Hawaii Attorneys for DUI
Drivers in Hawaii give consent to have a blood, breath or urine test to determine if they're intoxicated. While you can refuse to take a chemical test there may be consequences.
There are a variety of factors that determine your Blood Alcohol Content: your weight, sex, body fat, time between drinks and other factors. A BAC of .08 is enough to convict the average Hawaii driver. .04 is enough to convict a commercial driver. .02 is enough to convict a driver under 21.
There are challenges that can be made to a chemical test. Was the right machine used? Was the officer certified? When was the test given in relation to the arrest? A good Hawaii Attorney will attack the BAC results, any field sobriety tests and will investigate other defenses that may apply in your case.
